Privacy Policy

How BERGMAN collects, uses, shares, and protects information.

BERGMAN Race and Bergman Triathlon (collectively, “BERGMAN,” “we,” “our,” or “us”) respect your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you use the BERGMAN website, BERGMAN mobile application, event registration, live tracking, results, store, communications, and related services (the “Services”).

1. Information We Collect

Depending on the Services you use, we may collect:

  • Account and contact information: name, email address, phone number, city, state, country, account or athlete ID, login credentials or authentication tokens, club affiliation, and profile photo when provided.
  • Event and registration information: date of birth or age, gender, race category, age group, bib number, timing-chip identifiers, team or club, apparel selections, emergency-contact details, and medical or safety information voluntarily provided for an event.
  • Race, fitness, and results information: event participation, timing reads, split and finish times, rankings, race progress, estimated course position, official results, certificates, and race photos associated with an athlete.
  • Orders and transactions: registrations, purchases, order or payment identifiers, transaction status, amount, billing details, invoices, refunds, and fulfilment information. Payment-card and bank-account details are handled by our payment providers; BERGMAN does not receive or store complete card or bank credentials entered on a provider’s payment page.
  • App, device, and diagnostic information: user ID, a generated installation or device identifier, push token, platform, operating-system and app version, IP address, browser or device information, update-download information, and crash or update-failure data.
  • Usage and preference information: searches, saved or followed athletes, watchlists, notification state, privacy and live-tracking visibility choices, and interactions with features of the Services.
  • User content and support information: forms, enquiries, support messages, photographs, documents, feedback, and other information you choose to submit.
  • Website cookies and similar technologies: session, preference, security, and analytics information. You can control cookies through your browser settings where available.

The current BERGMAN mobile app does not continuously collect the phone’s GPS location. Athlete positions displayed in live tracking may be estimated from event course information and timing-system reads rather than the viewer’s phone location. If a future feature collects device location, we will request the required permission and update this policy and our app-store disclosures before using it.

2. How We Collect Information

We collect information directly from you; from event organizers, clubs, timing partners, photographers, and service providers involved in delivering an event; automatically when the website or mobile app communicates with our systems and integrated service providers; and from payment, communication, authentication, and fulfilment providers when they confirm a requested service.

3. How We Use Information

  • create and authenticate accounts and keep the Services secure;
  • process registrations, orders, payments, invoices, cancellations, and support requests;
  • operate events, allocate bibs, support athlete safety, and coordinate timing and logistics;
  • provide live tracking, watchlists, notifications, rankings, results, certificates, and race photos;
  • apply your visibility, communication, and notification preferences;
  • send transactional messages, race updates, safety notices, and permitted communications;
  • diagnose failures, deliver software updates, maintain availability, prevent fraud or misuse, and improve the Services; and
  • comply with legal, tax, accounting, safety, dispute-resolution, and regulatory obligations.

4. Live Tracking, Results, and Public Information

Event participation and official results may form part of the public sporting record. Depending on event rules and your visibility choice, public pages may show your name, bib, club, country, category, timing, rankings, race progress, photograph, or result. Where supported, you may choose Public or Anonymous live-tracking visibility. Anonymous visibility hides identifying profile details from public live-tracking surfaces, but it may not remove official results that an organizer is required or entitled to publish.

5. Notifications

If you enable mobile notifications, the app obtains a push token and registers it with a generated device identifier, platform, and app version so we can send event and athlete updates. You can withdraw permission at any time in your device notification settings. Disabling notifications stops future alerts but does not automatically delete other account or event records.

6. When We Share Information

We do not sell personal information or use mobile-app data to track you across apps or websites owned by other companies for targeted advertising. We may disclose information as needed to operate the Services to event organizers, race officials, clubs, timing partners, photographers, medical or safety teams, fulfilment partners, technology providers, payment processors, financial institutions, professional advisers, insurers, auditors, authorities, or a successor entity where permitted by law.

Our principal technology providers may include Firebase/Google, Cloudflare, Expo/EAS, Apple, Google Maps, and payment and communication providers used for the transaction or message you request. These providers process information under their own terms and privacy commitments and are required to protect it consistently with applicable law and their role in providing the Services.

7. Data Retention and Deletion

We retain information only for as long as reasonably necessary for the purposes described in this policy. Retention depends on the type of record and may continue while your account is active, while an event or transaction is being administered, or while needed for security, backup, dispute resolution, tax, accounting, insurance, safety, or other legal obligations.

Authentication, push-token, watchlist, and preference records may be deleted or deactivated when they are no longer needed or when a valid deletion request is completed. Transaction, registration, timing, and official-result records may be retained where required by law or as part of the legitimate historical sporting record. Backup copies may remain for a limited period until overwritten through normal backup cycles.

8. Your Privacy Choices and Rights

Subject to applicable law and necessary event-record exceptions, you may ask us to access, correct, export, restrict, or delete your personal information, withdraw consent, or object to certain processing. You can also change supported live-tracking visibility settings in your account and manage cookies or mobile notifications through your browser or device settings.

To make a privacy or account-deletion request, email info@bergmantri.com with the subject “Privacy Request” or use our contact page. Include the email address associated with your account and enough information for us to verify and locate the relevant records. We may request reasonable identity verification before acting and will respond within the period required by applicable law.

9. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information, including access controls and secure transmission where appropriate. No internet transmission or storage system is completely secure, so we cannot guarantee absolute security.

10. Children and Junior Athletes

Junior athletes may participate with the authorization of a parent or guardian where required. A parent or guardian may contact us regarding a junior athlete’s information. The Services are not intended to invite children to create accounts or submit personal information without the involvement or consent required by applicable law.

11. International Processing

Our providers may process information in India and other countries where they operate. Where required, we use appropriate contractual or legal safeguards for international transfers.

12. Changes to This Policy

We may update this policy when our Services or legal obligations change. We will post the revised policy at this URL and update the date above. We will provide additional notice when required by law or when a change materially affects your privacy choices.
